It looks as though the confusion may have stemmed from the document uploaded onto the MCMS request, as the title is "SAM202000057 Tees Estuary Sample Plan Response". Now that we have the correct corresponding sample plan reference (SAM/2021/00027; Joe PErry and Chris Barrett) we should be able to amend my initial advice provided on the 20th December - see below. As detailed by PDT, the requirement to test for PBDEs - flagged as a major comment in my initial advice (20/12/2021) - along with PCBs and OCs was only recommended for the areas which are currently excluded on their licence. As such, this invalidates my initial major comment as PDT are not, within this consultation, seeking to reinstate the excluded areas. Therefore the evidence submitted is sufficient to support the discharging of this mid-licence sampling return. Good Morning Joe, Thank you for providing Cefas’ response for the Tees maintenance samples, L/2015/0042/6. We have forwarded your response onto the applicant and have copied their response below. There seems to be an error with the sampling plan that was reviewed and as there were no issues with the continued disposal of material to sea, please could you advise whether a re-consultation with Cefas is required or whether the below points are satisfactory to close out any concerns and discharge the return? Applicant’s response: * Cefas refers to a sampling plan from August 2020, with reference SAM/2020/00057. This is the incorrect sampling plan reference, as we received a sampling plan in June 2021 with reference SAM/2021/00027. This explains why we have taken 20 samples with analysis for metals, organotins and PAH, as requested by Cefas (rather than the 8 samples referred to by Cefas in the response) (as per para 2.2 of the sampling plan copied below for reference). * During the sampling plan exercise, PDT requested whether it could re-sample within areas currently excluded on the maintenance licence (to bring such areas back into the source area) (this is detailed in para 2.3 of the sampling plan, also copied below for reference). A specification for analysis of such samples was provided by the MMO within the sampling plan, should PDT want to sample within those areas (the full suite of analysis was required for those samples). PDT has not sampled in currently excluded areas as part of this mid-licence sampling exercise – it decided to simply comply with the requirements to sample at 20 locations within the current source area – the 20 samples provided align with the request in para 2.2 of the sampling plan. Para 2.2 of sampling plan for reference: In consideration of the volume details of the proposed dredge, the MMO advises that 20 samples should be taken from within the footprint of the proposed dredge area to provide adequate spatial coverage….. Para 2.3 of sampling plan for reference: To support an application to reincorporate currently excluded areas into the licence, one sample site from each area, totalling 5 sample sites (there are 6 currently excluded areas; please refer to point 5.1 for the sixth one), will be required. These samples should be in addition to the 20 sample sites for the mid-licence sampling condition.
